The opposition was directed against a design (logo) reg. No. <strong>D 15 715 3.01 <\/strong>(hereinafter \u2013 Design).\r\n\r\n<img class=\"aligncenter wp-image-5354 \" src=\"https:\/\/petpat.lv\/wp-content\/uploads\/2020\/11\/Screenshot-2020-11-16-at-11.36.02-e1605519884804.png\" alt=\" width=\" height=\"106\" \/>\r\n\r\nChanel SARL was represented by trademark attorney\u00a0<a href=\"https:\/\/petpat.lv\/en_lv\/employee\/gatis-merzvinskis\/\">Gatis Mer\u017evinski<\/a>s and trademark attorney <a href=\"https:\/\/petpat.lv\/en_lv\/employee\/kristine-ostrovska\/\">Krist\u012bne Ostrovska.<\/a>\r\n\r\nThe opposition relied on:\r\n<ul>\r\n \t<li>Trademarks that are<strong> well known in Latvia<\/strong> <strong>\u2013<\/strong> including <strong>No<\/strong>. <strong>5<\/strong>, <strong> 5<\/strong> and\u00a0 <img class=\"alignnone wp-image-5358\" src=\"https:\/\/petpat.lv\/wp-content\/uploads\/2020\/11\/timg.jpg\" alt=\" width=\" height=\"36\" \/> ;<\/li>\r\n \t<li>Allegation, that Design <strong>lacks novelty<\/strong> and <strong>individual character<\/strong>;<\/li>\r\n \t<li>Distinctive signs are used in Design \u2013 prior marks, whose owner is entitled to prohibit such use;<\/li>\r\n \t<li>use without due cause of Design could take <strong>unfair advantage<\/strong> and be <strong>detrimental<\/strong> to the distinctive character of the earlier trademarks.<\/li>\r\n<\/ul>\r\nGiven the evidence before it, the Board of Appeal came to the conclusion, that:\r\n\r\nThere is a risk, that Design and the prior marks, namely,\u00a0<img class=\"alignnone wp-image-5362\" src=\"https:\/\/petpat.lv\/wp-content\/uploads\/2020\/11\/1244499.jpeg\" alt=\" width=\" height=\"56\" \/>\u00a0 and\u00a0 <img class=\"alignnone wp-image-5358\" src=\"https:\/\/petpat.lv\/wp-content\/uploads\/2020\/11\/timg.jpg\" alt=\" width=\" height=\"39\" \/>could create a similar overall impression, since they contain a monogram dominated by distinct lines and consisting of two identical, symmetrically arranged elements. Consequently, the Board of Appeal stated, that <strong>Design lacks individual character<\/strong>. However, it is new and is novel, as the design is not identical to any of the prior marks.\r\n\r\nDesign is reproduced in a way that causes confusion with the well-known trademark <img class=\"alignnone wp-image-5358\" src=\"https:\/\/petpat.lv\/wp-content\/uploads\/2020\/11\/timg.jpg\" alt=\" width=\" height=\"39\" \/> . The Board of Appeal stated that the two fives included in Design are positioned in a way that their lower parts actually reproduce the prior mark\u00a0 <img class=\"alignnone wp-image-5358\" src=\"https:\/\/petpat.lv\/wp-content\/uploads\/2020\/11\/timg.jpg\" alt=\" width=\" height=\"39\" \/>.\r\n\r\nThe Board of Appeal agrees with the opponent, that a possibility may not be excluded, that Design can be used for fashion goods as well.
