Changes in the Out-of-Court Dispute Resolution for Latvian Top-Level Domain (.lv)
Starting from October 1, 2024, a regulation will come into effect stating that the out-of-court dispute resolution for the .lv top-level domain will be handled by the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center.
Until now, these disputes were resolved through negotiations, arbitration, or in court.
The anticipated changes in Latvia will ensure a fast, efficient, objective, and much simpler resolution of cross-border disputes between a domain name user and a party that believes its rights are being violated, especially when one of the parties is a foreign entity.
The WIPO Arbitration and Mediation Center will act as a third party that, based on the arguments and evidence submitted by both sides, will make a decision to be enforced by the respective top-level domain registry
The Uniform Domain Name Dispute Resolution Procedure (UDRP) offers several advantages: speed, efficiency, reduced costs, accessibility, and reliability, particularly in the context of the international competence of the WIPO Arbitration and Mediation Center in domain name dispute resolution matters.
